I think that the amendment desired by the

Chamber of Commerce should be made. The conditions in Hongkong

and in Shanghai are similar. In each place the Court is composed

of but two Judges,

In Shanghai either party to an motion is

entitled as of right to a jury where the amount involved exceeds

£150. That in a right which in my opinion should be extended to

His Majesty's subjects in Hongkong where there is nothing to

distinguish the case of the suitor from that of the suitor in

Shanghai.

I base my opinion upon what I conceive to be

a broad principle of justice that a party to an action should

not be forced against his will to submit to the decision of a

single Judge, however capable a lawyer he may be, on important

issues of fact.

I think that the general right to demand a

trial by Jury which existed up to 1901 should be restored. In

my opinion a man charged with fraud should possess the right to

be tried by a jury.

I advise that His Excellency invite the

considered opinion of the Law Society upon the request made by

the Chamber of Commerce and that thereafter an expression of

the views of Their Honours the Judges should be sought.

The sanction of the Secretary of State

should be obtained previous to any legislation.
